Advert For Malaysian Palm Oil Banned in UK

The banned on Advert For Malaysian Palm Oil in UK, set another blow to the credibility of Malaysia’s palm oil industry. In Sarawak the project has been widely introduced and affected the Native Customary Land (NCR). The struggle is still ongoing by the native against the corporate body awarded Provisional Leasing (PL)so as to Land & Survey Dept, who fully influence by goverment.

Members of the hunter-gatherer Penan tribe in Borneo have welcomed the ban, saying, "Oil palm plantations have not benefited us at all; they have only robbed us of our resources and land."

The advert claimed to misled the public by claiming production of palm oil as "sustainable and socially useful".

"Our research shows that Malaysian palm oil production is not sustainable - it destroys forests, increases carbon emissions, and forces local communities off their land".-Kenneth Richter, Friends of the Earth biofuels campaigner

A Call of Spirit To Stop The Dam By The Sabahan

The objection from most of the effected areas over Hydroelectric project is not only in Sarawak, but spread to Sabah where newly proposed dam strongly objected by the local.

Recently, a group of the Native in Penampang, Sabah took a traditional method to stop the newly proposed Koiduan Dam, costing a massive RM2.8billion by doing a traditional ritual,unleashing the spirits of PITOUAN TONDUK upon the heartless leaders of Sabah over their arrogance in approving the project .

The Pitouan Tonduk or "Batu Sumpah"(curse stone) ritual (left) was performed with the slaughtering of a pig with it's blood overflowing the curse stone. The sacred "Curse" ceremony is only directed on heartless people who have malicious intent against the villagers.

Are We Denying Our Own NCL Right?

Our ancestor after a series of migrations has created a ‘temuda land’ some of which has been abandoned for many years for some reason. Some land may called ‘tu’an” as defined by Temenggong Pahang but is still part of our NCR (Native Customary Land) where the native reserved the forest for it was rich of natural resources. And some had been abandoned for more than 100 years after padi planting by their anchestor and always misunderstood by the new generation as the “tu’an” with no ownership and event worst when they came into contact with privates company who always wanted the land and defined its as “ State Land”.

There is many cases and occasion the native had claimed such land and wanted the government to recognized their right over the land. Until now, none of the native land has been given the right. Hence, the government agencies like LCDA play an important roles to introduce the native land to their allied for their lucrative business with minimum costs. For one reason, the compensation paid in very low and unreasonable price. Secondly, they only pay some portion of the land to where native proven their Temuda and the rest is “State Land”. With less monitoring from local leader, some of the native has taken ownership of such “tu’an” which caused unequal distribution of the compensation among the individual. This is so call profit-making JV business between the corporate and individual. Look, all the land, within our territorial domain was and is belong to us, up to boundary of neighbouring kampung.

Contradictly, the comments from Chairman of Orang Ulu National Association (OUNA), Peter Jalong as below:
"There is no ground for anyone to claim the whole jungle in Baram belonging to him because his fathers had roamed as nomads in the jungle.
"But we Orang Ulu never made such claim even our forefathers had roamed and lived in the jungles for years before settling down," – Eastern Times

Sarawak Lakiput Association Proposal Over NCR Land.

The Sarawak Lakiput Association (PLS) has proposed to the state government to set up integrated agriculture projects in their areas of which only comprise Benawa, Kuala Tutoh, Lubok Nibong and Kampung Datuk Galau.

Simon Dayak Gelan, who is the president of PLS has said he had written a letter of consent to the authority concerned several times for approval of his proposal, but had yet to receive a reply.

“This is not a complaint or that I am against anyone of authority, but I am concerned for the interest of the Lakiputs and their future economic sustainability,”reporting to be said.

Petition To Stop Baram Hydroelectric Project

On Tuesday, 22 Sept,the community forum on dam development held at Telang Usan Hotel to caimpaign and gain support from the indegenous to stop the proposed 1000MW hydroelectric dam project in Baram.All Telang Usan folks were called give full support by signing the petition which is still underway and expected to be sent end of the month.

The campaign started with collecting the signatures from the Kenyah, Kayan, Kelabit, Saben and Penan communities.This is a part of continous effort taken by the native together with the NGO to express their objection to all 12 proposed dams in Sarawak.

This Forum was attended by Johannes Luhat representing Long San and Philip Jau from Long Laput. Earlier, Philip has attended the Seminar Hak Tanah Adat Orang Asal at Long Banyok on 20-21 Sept.When commenting on his involvement in this struggle,he has expressed his deep disappointment over the project and the state goverment dealing with the isssues. He is one of the natives who was arrested when when joining a group of indiginous in Kuching recently to send the petition to the state goverment.

BARAM HYDRO-ELECTRIC DAM PROJECT

Sarawak Government plans to build more hydro-electric dams to meet the state’s future industrialisation needs. In addition to the Bakun dam project, the Sarawak Government are planning to build another 12 hydro-electric dams at Ulu Air, Metjawah, Belaga, Baleh, Belepeh, Lawas, Tutoh, Limbang, Baram, Murum and Linau rivers including an extension to the Batang Ai Dam.

Sarawak Energy Berhad (SEB), 65 percent owned by the Sarawak is spearheading these dam projects.

The project

The Batang Baram is the second longest river in Sarawak. The river drains much of the Sarawak northern region as it originates in the central Iran Mountains at the Sarawak/Malaysia-Kalimantan/Indonesia border. It flows westwards through tropical rainforest in the Baram District to the South China Sea. The Miri Resort City is located at Baram delta.

The Baram Hydroelectric dam site is located along Baram River at about 306 Km from the river mouth. The location of the dam across the Baram River will be between the inflows of the Sungai Patah and Sungai Kahah from the left and Sungai Hit from the right, as going upstream.

The height of the main Baram dam would be 162 m above foundation level. The dam structure across the Baram River has a crest length of 685 m and the crest level is 180 m above sea level. The construction would be designed as a roller-compacted concrete (RCC) gravity dam. Due to the topographical conditions in the project area, a 70m high Saddle dam will be constructed approximately 5 Km south-west of the project site.


Who are affected by Baram dam?

If the project goes ahead, an anticipated of at least 20,000 indigenous peoples will be affected and displaced by the dam. These peoples are the Kayans, Kenyahs and Penans whose longhouses and villages are situated along the course of Baram River valley, locally known as Telang Usan. Their settlements are well located on below, above and around of the project site.

The downstream longhouses/villages are Long Laput, Sungai Dua, Sri Kenawan, Uma Bawang, Long Miri (Daleh Pelutan), Long Pilah and Long Kesseh. In the upstream and within the dam reservoir area are Long Na’ah, Long Liam, Long San, Long Selatong (Kiri & Kanan), Long Apu, Long Julan Asal, Long Julan Pelutan, Long Anap, Long Palai, Long Je’eh, Long Moh, Long Sela’an and Long Semiyang as well as some villages in Akah River that are Long Beku, Ba Abang, Long Tap and Long Tebangan.

The Baram dam would submerge an area of 38,900 hectares (389 sq km) of land and forest. The area is mostly native customary land, and consists of temuda, cultivated lands, gardens, villages, churches, graveyards, community forests and sites of historical significant. The people are going to lose their longhouses, villages, properties, lands and forests as a result of submergence and displacement by the Baram dam.

The construction of Baram dam will create a catchment area of 896,600 hectares (8,966 sq.km). Within the catchment area are some major settlements of indigenous communities: the Kenyahs, Kelabits, Sabens and Penans.

The dam will submerge the existing government schools, Medical clinics, airstrip and other building facilities. There are also logging companies actively operating in the area.

Santapan Minda

Perkembangan dan suasana politik semasa, ternyata meransang golongan muda dan golongan professional untuk cuba menyedarkan golongan tua yang berada di kampung untuk memahami masalah dan isu sebenar yang mengengkang pembangunan selari dengan negeri lain di Malaysia. Disebalik mengenal pasti masalah pokok ini, mungkin tidak terlintas perkara yang dianggap remeh mungkin membawa kepada kesan yang besar dan mengikat pemikiran kita pada tampuk lama.

Pertama, kita mungkin terlalu mengabaikan cara dan pemikiran golongan tua yang berada di kampung yang rata-ratanya telah mendaftar sebagai pengundi. Sesetengah pihak mungkin melihat perkara ini penting dan mengambil kesempatan untuk meraih kuasa. Ini adalah kerana golongan inilah yang sebenarnya yang menjadi penentu kepada mandat kepada wakil rakyat. Malangnya golongan muda dan ahli professional kebanyakkannya berada di Bandar. Usaha membawa arus idealisma oleh golongan ini ternyata bersifat sementara dan tidak meninggalkan kesan di dalam penentuan kepimpinan politik meskipun banyak idea baru yang dibawa. Harus kita sedar bahawa pemerintah negeri sekarang tahu akan kelemahan ini dan mencengkam pemikiran golongan tua hingga dapat mengubah “mindset’ mereka. Adakala kita tergamam apabila dikatakan Pelitah=BN, tak ada BN tak ada Pelitah, tak ada Pelitah tak ada pembangunan. Perkara ini dinyatakan oleh salah seorang responden dari kampung berkenaan kefahaman politik beliau.

Walaupun konsep ini ternyata memesong, ia tetap dimainkan oleh sesetangah pihak bagi mengunci segala pemikiran golongan tua untuk terus memerintah. Juga kita mendapat tahu bahawa ramai daripada golongan ini berpendapat bahawa, tidak ada alternative langsung selain daripada Pelitah (merujuk kepada BN). Ternyata pemikiran seperti ini dipupuk oleh kenyataan wakil rakyat mereka dan juga ketua-ketua masyarakat sejak sekian lama. Sehingga adakalanya,menyambut wakil rakyat mereka dengan penuh tradisi dan terhormat tanpa melihat setitik kelemahan mahupun penipuan sekalipun.

Cuba bayangkan jika pemikiran yang telah dibentuk seperti yang dinyatakan melihat kepada kenyataan ini:

“Good things are happening under the BN government and there is no other alternative than the BN government to implement progress and development for the people,” Lihan Jok (DUN Telang Usan)

Maka, ia dilihat dengan sebelah mata sahaja tanpa berpijak kepada dunia nyata bahawa sebenarnya banyak parti politik yang wujud dan bergelut membawa ideologi tersendiri bagi membentuk kerajaan yang lebih baik.

Golongan muda, ahli akademik dan golongan professional sering kali diseru untuk terlibat sama dalam suasana politik Telang Usan. Selain daripada membetulkan cara pemikiran golongan tua kita, penglibatan secara 'turun padang' adalah perkara terpenting. Walaubagaimana sekalipun kita memekik, melolong keadaan tidak akan berubah sekiranya kewajipan sebagai rakyat untuk mengundi tidak ditunaikan. Media electronik dan media masa terus memainkan peranan, disamping ceramah yang bertali arus oleh sesetangah pihak akan terus memperkuatkan cara pemikiran konservatif orang tua kita. Ini disambut dengan “gula-gula” terutama menjelang pilihanraya.

Ini adalah kenyataan politik di Telang Usan yang merebak bagaikan wabak ke seluruh kawasan pedalaman dari dahulu lagi. Simtom ini merupakan perkara lama dan terus menular hingga sekarang. Dunia sekarang membawa arus anjakan paradigma (Paradigm Shift), namun pemikiran kita terus terpinggir dan dimanipulasikan oleh ahli politik untuk terus memegang mandat pada masa yang sama menjajah minda kita untuk terus kekal pada tampuk lama.

Update: Seminar Hak Tanah Adat



Pelancaran Seminar Hak Tanah Adat yang diadakan di Long Banyok Baram telah berjalan dengan jayanya. Seperti yang dirancang,atur cara bermula pada 20/9/09 kira-kira 8.00pm dan berakhir pada jam 12.00 malam.Hari berikutnya,21/9/09 bermula 8.am dan bersurai pada 3.00 petang.

Program ini diserikan dengan kehadiran tetamu istimewa yang mewakili badan bukan kerajaan, TAHABAS yang diketuai oleh Presidennya sendiri En Michael Jok, Mark Bujang dari BRIMAS dan 4 Orang peguam terkenal berkenaan kes tanah,En Baru Bian,En Nyipa (Ali Basah), En Paul Raja dan En Abun.Turut hadir juga adalah Tuai Rumah Nor a/k Nyawai dan juga En Philip Jau dari Lg Laput.Walaupun terdapat khabar ada pihak yang telah membuat laporan Polis dan memberi notis bantahan terhada program ini, namun seminar kesedaran ini tidak menhadapi apa-apa halangan dan perkara yang tidak diingini berlaku. Malah, terdapat rombongan dari Lg Panai, Batu Belah,Uma Akeh, Long Puak, Long Laput, Long Miri, Na'ah dan Long Banyok sendiri untuk memberi sokongan.

Antara lain, peguam Baru Bian dalam ucapanya menyatakan program yang julung kali diadakan di Long Banyok ini merupakan satu sejarah kepada diri beliau kerana ia dihadiri oleh 4 peguam.Turut disentuh adalah isu-isu perundangan yang berkaitan dengan tanah dan juga perkongsian pengalaman yang dihadapi oleh Orang Asal di seluruh negeri Sarawak yang dibawa oleh keempat-empat peguam yang datang.Disamping itu Tuai Rumah Nor, berkongsi pengalaman yang amat berharga dari kampung beliau yang pernah bergelut dengan kes tanah dan akhirnya memenangi kes tuntutan tanah NCR di Mahkamah Tinggi.

Paul Raja yang berasal dari Long Lelang juga berkongsi pengalaman yang dihadapi oleh kampung beliau dan juga turut menjelaskan konsep demokrasi yang diamalkan di negara ini dan juga hak bersuara.Juga menerangkan segala punca yang membawa kepada permasalahan tanah adat yang melibatkan orang yang berkepentingan dan juga ketua-ketua masyarakat.

"Kamu budak sekarang jangan takut dan terus berjuang menjaga hak tanah kita supaya kompeni tidak mudah memperdayakan kita. Kami, dari dulu berjuang dan tidak putus asa hingga sekarang" kata Barah Aning, salah seorang rombongan dari Uma Akeh ketika memberi komen kepada program ini.

Dam Protester Held

A group of natives together with Borneo Resources Institute Malaysia (Brimas) and TAHABAS members taken further steps to send a message to state goverment to stop the Hydroelectric project which affected Murum and Baram. While peacefully trying to hand over the memmorandum of protest at Wisma Wisma Bapa Malaysia, they were arrested by SB (Special Branch) who already at the scene to disperse the crowd and finally held them.

Meanwhile, a group spokeperson Philip Jau from Long Laput, Baram among the those arrested. Baram is among the 12 proposed dam in Sarawak covered a big areas of native's ancestral land which belong to Kayan, Kenyah,Penan and Saban of Ulu Baram. The widespread sentiments against the propose project draw attention to both Baram MP and DUN of Telang Usan.To date there is no comments from the dual.Continuous effort still actively to reach all the affected areas and the native to give awareness about the potential risk from the project.

Bos, Don't Tell Lie..!

The Baram Hydroelectric dam seem to be executed without the majority consents so as to undergoing project in Murum dam. Surprisingly the objection from the mass turned to wrongful message from the politician that they have the majority to proceed with the project. Again, the NGO has been victimized of being the influence the folks . Same to Murum, those affected by Baram Hydroelectric dam trying to convey the message to government and send their humble plight to stop the project .

In his reply to the objection to Hyro project, Land Development Minister Dato Sri James Masing said the majority of the people do agree to the project and accused the NGO instigate the native to oppose the project. Same goes to Mambong MP who is also the chairman of Social and Environment Impact Assessment (SEIA) steering and working committee for the project said it was “nonsense” to say that the Penans have disagree with project when refer to objection by the Penan at Murum.

Now the thing is not really going right when the politician continuously tell lie to the people rather than giving clear explanation about the pro and con resulted from the projects. Facing with the conflict of NCR which being leased to the corporate company for Oil palm plantation and the logging activities, the native really in the deep trouble and hoping that the current government could think about their future parallel with the ‘development’

Immediate Action Should Taken Place Over Penan Rape Cases


The Penan women rape case have been revealed after special task force set up by the goverment, release the 111 pages report about the Penans development at Ulu Baram and some interview with the rape victims.The report also revealed the imbalance development, one of the factor they have been exploited.

Meanwhile, Minister of Rural DevelopmentRural, Datuk Patinggi Tan Sri Alfred Jabu give deffensive remark over the allegations and question the credibility of the report and said the "Negative" NGO play stroghly behind it. The report is the actual fact as what the people in Baram experience before as some of them live closely with the Penan especially the Kayan and Kelabit.One of the example is the Kayan settlement at Long Bedian who almost everyday visited by the Penans nearby trading thier goods at the Long Bedian mini bazaar.Most of the people in Baram know the story about the Penan since many of them working with the logging company.The sexual harrasment allegation by the Penans actually not new among the people in Telang Usan but it known many years back among the local tribes.

Unfortunately, Jabu denying the allegations and accused the NGO may take a major influence on the finding.Bruno Manser, the Swiss activist one of individual been blamed for the Penans adamant toward accepting "development". In many occasion, the jounalist and the activist accused to influenc to stay put in the jungle and rejecting the goverment. But at the other hand some party trying to "educate" the Penans to accept development agenda of which including the Oil Palm Plantation and the lucrativet Timber business.In reward, Penans have to sacrifice their forest and its resources to give a way to "development".This is one of the major factor that the Penans come to close contact with outside world and this social crime most likely to happen.Beside that, to exploit their land and resources in the name of "development.

Many believe that the immediate action must be taken place. The Penans really need the assistance especially when they going throught a very hard times protecting their land again the timber companies and their people against the logging workers .The report from the special force is the fact and stern action should taken place against the culprits.

Nak wat camner? Kalo penduduk pesisir jalan lapok tu sendiri yang x ambil tindakkan. Tunggu 2020 nanti, time tu semua orang dah pakai Self Flying machine. Baru dorang celik mata tgk semua OU balik kampung terbang pakai sayap je. Sekarang kan Ahli sains dah cipta saya seperti rerama utk manusia terbang. Toksah le kiter pakai keta lagi.

Sekarang ni kan dorang jeles tgk semua OU ade 4WD majority. Tu le sbb x der orang nak amek kesah sgt pasei jalan tu. Kiter yg susah mintak jalan dibaiki.....OU yg senang memakai. Biar je lah...mmg dorang ckp camtu. Dan dorang pun dok diam je lah.

Tapi yg best nye sekarang, buat pengetahuan semua. Kiter dah dapat online dari pekan lapok dah. Aku dah cuba.....harap semua kampung kat Ulu tu dpt online pas ni

The same project which have been delayed years after years or elections after elections was in the limelight again. Why? Election is coming soon and it must be seen as an ongoing fight. A false impression created as if the YB have been fighting his butt to get it done. In the end, very little or none can be achieved. It goes into history book, ready to re-appear again after 4 years. If you look at Semenanjung Malaysia, you will never see any case of long overdue road project. Road is too important for them > key enabler to economic and social development. They really fight for it to get it done.

If like this , all those who blame the YBs for Jalan lapok, will be blocked to used that road to go home. They will have to use the jungle or the river to go home instead. Not even toll accepted. These people never appreciate the effort by the YBs for this road development. Lets see where and who shall listen to your complaint. You will keep on complaining even without knowing where is jalan lapok is and what is jalan Lapok. Thats unfair abit lah. Ask the fellow who is the forefront of cash flow into Sarawak. Where have all the money gone? I think he will listened to you and give you some answer like " semua duit itu, itu duit semua...."...

Kenyataan Mesyuarat Masyarakat Orang Asal Sarawak Sempena Seminar Mengenai Hak Tanah Orang Asal Yang Dianjurkan

KAMI, Ketua-Ketua masyarakat, ahli-ahli Jawantankuasa Kemajuan dan Keselamatan Kampung (JKKK), ahli-ahli Persatuan-Persatuan Orang Asal, ahli-ahli Persatuan Rumah Panjang/Kampung serta wakil-wakil Rumah Panjang masyarakat Orang Asal di Sarawak telah bermesyuarat di Hotel Habour View, Kuching, Sarawak pada 28 – 29 Mac 2005 sempena Seminar mengenai Hak Tanah Orang Asal yang dianjurkan oleh SUHAKAM untuk membincangkan masalah-masalah yang dihadapi oleh masyarakat kami.

Terlebih dahulu, kami ingin menyampaikan setinggi-tinggi tahniah dan terima kasih kepada pihak SUHAKAM kerana memulakan inisiatif untuk menganjurkan Seminar sebegini yang julung kali diadakan untuk seluruh Negeri Sarawak. Adalah diharapkan bahawa inisiatif sebegini dapat diteruskan oleh pihak SUHAKAM bukan sahaja di Sarawak tetapi di seluruh Malaysia demi melindungi hak Orang Asal di Negara yang kita cintai ini.

Hasil daripada perbincangan tersebut, kami telah mengenal pasti isu dan masalah yang sedang kami hadapi seperti berikut:

1. Kawasan Tanah Adat kami diceroboh oleh syarikat-syarikat swasta untuk menjalankan aktiviti-aktiviti pembalakan, perladangan komersial secara besar-besaran dan pembangunan-pembangunan yang lain tanpa terlebih dahulu mendapat izin dan persetujuan dari kami;

2. Pencerobohan oleh syarikat-syarikat swasta tersebut telah melanggar adat, budaya dan tatasusila kaum masyarakat kami. Syarikat-syarikat tersebut juga tidak menghormati Hak Adat kami dan telah mencabuli hak tanah NCR kami terutamanya ke atas “Pulau” dan “Pemakai Menoa” kami;

3. Kerajaan Negeri Sarawak sering kali mengeluarkan “Provisional Lease” dan lesen pembalakan sebarangan kepada syarikat-syarikat swasta yang melibatkan kawasan Tanah Adat kami tanpa terlebih dahulu memaklum dan mendapat keizinan bebas kami (without our free prior informed consent);

4. Tempoh 60 hari daripada tarikh warta dikeluarkan oleh Kerajaan Negeri kepada masyarakat kami untuk mengemukakan tuntutan pampasan ganti-rugi terhadap harta-benda kami sekiranya Tanah Adat kami diambil milik /dihapus (acquired) oleh Kerajaan Negeri adalah terlalu singkat dan warta tersebut tidak tersebar ke semua lapisan masyarakat kami;

5. Pampasan yang kami terima daripada Kerajaan Negeri jika Tanah Adat kami diambil milik oleh Kerajaan adalah hanya untuk harta-benda dan tanaman yang terdapat di atas Tanah Adat kami dan tidak termasuk nilai sebenar tanah tersebut. Pampasan yang diterima untuk harta-benda dan tanaman kami juga tidak setimpal dengan nilai pasaran terkini;

6. Kebanyakkan Tanah Adat kami tidak mempunyai rekod atau dokumen rasmi yang mengesahkan bahawa Tanah Adat yang kami duduki adalah hak milik kami. Kerajaan Negeri tidak menjalankan survei pemetaan ke atas sempadan kawasan Tanah Adat kami oleh itu sering terjadi konflik di antara pihak kami dengan syarikat-syarikat swasta;

7. Akibat daripada aktiviti-aktiviti pembalakan, perladangan dan industri-industri ekstraktif yang dilaksanakan di atas Tanah Adat kami maka terjadinya kerosakkan terhadap tanaman-tanaman serta harta benda kami. Pencemaran alam sekitar juga sering berlaku, contohnya berlakunya tanah runtuh, air sungai menjadi keruh dan cetek akibat lumpur lalu mengakibatkan banjir dan serta menjejaskan sumber air minuman kami.

Dengan Kenyataan ini kami mengesa SUHAKAM untuk meyarankan Kerajaan Pusat dan Kerajaan Negeri Sarawak untuk:

1. melindungi Hak Adat (NCR) dan hak-hak kami di atas tanah adat serta sumber daya kami dengan meminda Seksyen 5(3) Kanun Tanah Sarawak (Sarawak Land Code) berkenaan dengan penghapusan Hak Adat masyarakat Orang Asal ke atas Tanah Adat untuk tujuan umum di mana sebelum hak masyarakat orang asal ke atas Tanah Adat dihapuskan suatu sesi dialog harus diadakan dengan masyarakat yang terlibat;

2. menjalan survei pemetaan dan merekodkan semua tanah NCR masyarakat Orang Asal di Sarawak serta memberikan dokumen rasmi yang mengesahkan hak milik Orang Asal ke atas Tanah Adat, dengan ini, konflik tentang kawasan dan hak-hak tanah antara masyarakat orang asal dan kerajaan dapat di atasi;

3. menghentikan pengeluaran “provisional lease” dan lesen pembalakan secara sebarangan kepada syarikat-syarikat perladangan dan pembalakan yang melibatkan kawasan tanah NCR kami sehingga survei pemetaan dapat dilaksanakan untuk menentukkan lokasi dan keluasan “Provisional Lease” dan lesan balak tersebut dan mengeluarkannya daripada Tanah Adat kami sekiranya didapati telah memasuki kawasan tersebut;

4. mengarahkan syarikat-syarikat swasta yang beroperasi dalam kawasan Tanah Adat kami untuk menghentikan kegiatan mereka dengan segera sehingga pertikaian hak ke atas tanah tersebut diselesaikan;

5. menghapuskan tempoh 60 hari untuk warta kerajaan yang mewartakan pengambilan hak milik Tanah Adat kepada Tanah Kerajaan dan sebaliknya mengadakan perbincangan dengan semua pemilik tanah yang terlibat sehingga sebuah penyelesaian dipersetujui oleh semua pihak;

6. mengumum dan mengedar salinan warta kerajaan tentang projek atau rancangan kerajaan yang berkaitan dengan hak NCR kami kepada tiap-tiap rumah panjang/kampung di kawasan yang terlibat/terjejas oleh warta tersebut;

7. memberitahu dan mengadakan perjumpaan dengan semua lapisan masyarakat rumah panjang/kampung mengenai perancangan pembangunan tanah adat di kawasan kami, seterusnya menghormati segala keputusan yang diambil oleh masyarakat kami;

8. membayar pampasan untuk Tanah Adat yang diambil milik oleh kerajaan yang setimpal dengan nilai pasaran terkini dan tidak terhad kepada tanam-tanaman dan harta-benda di atas tanah tetapi termasuk nilai sebenar tanah tersebut;

9. mengubal dan meminda undang-undang yang melibatkan hak masyarakat Orang Asal supaya ia mesra Orang Asal serta menyokong undang-undang adat masyarakat Orang Asal demi memperkukuhkan hak mereka dan bukannya menghakis hak tersebut;

10. meminda Kanun Tanah Sarawak untuk khususnya memasuki “pulau”, “temuda” dan “pemakai menoa” di bawah definisi Tanah Adat Orang Asal (Native Customary Land) di bawah Seksyen 2 Kanun tersebut;

11. meminda Bahagian IV “Practice of Land Surveyors ETC.” Seksyen 17 Ordinan Jurukur Tanah (Land Surveyors Ordinance) yang mengatakan “without prejudice to Section 104 of the Code, no person shall unless he is a land surveyor” dengan “Nothing in this Ordinance shall affect the righ of any person, not being a land surveyor to undertake surveys other than title surveys”.

12. menubuhkan suatu pesuruhanjaya bebas khas (National Native Land Commission) untuk mengendali hal-hal dan menyelesaikan isu-isu yang melibatkan hak masyarakat Orang Asal di Malaysia.

Maka kami dengan sebulat suara menyatakan sokongan kami ke atas usaha yang diambil untuk menyelesaikan isu-isu dan masalah-masalah kami seperti di atas:

Hakikat NCR

Clause 23: …..Hakikatnya, sejak tahun 1970 memang Ketua Masyarakat Kayan Kenyah sudah berkali-kali dan bermati-matian momohon Kerajaan menyukat tanah dan memohon surat-surat yang perlu. Kerajaan selalu menjawab tidak perlu memberi surat tanah temuda. Dengan alasan tanah NCR tidak boleh diambil oleh orang lain kerana ia diiktiraf oleh kerajaan. Kebun-kebun adalah sebagai geran tanah kamu yang di pedalaman. Kampung kamu sudah beratus tahun berada di sana itulah sebagai bukti dan geran tanah kamu katanya. Tetapi yang terjadi sekarang kompeni tidak peduli. Apabila tuntutan dan permintaan orang tempatan tidak ditunai dan tidak dipedulikan oleh kompeni, terpaksalah mereka mengambil tindakan Undang-Undang, malah juga melanggar undang-undang bagi meneggakan keadilan serta menuntut hak mereka. Perkara ini harus diberi perhatian sewajarnya oleh pihak kerajaan dan mempastikan masyarakat kami tidak ditindas, disamping hak kami wajib dihormati.
